Biometric Information Retention & Destruction Policy

Frictionless AI, Inc., doing business as Smooth AI ("Smooth," "we," "us," or "our"), provides an optional AI Voice feature that allows users to generate translated speech in a voice resembling their own.
This policy describes how Smooth retains and destroys voice data that may constitute biometric identifiers or biometric information under applicable law, including the Illinois Biometric Information Privacy Act ("BIPA"). This policy supplements our Privacy Policy.
1. Voice Data We Process
When you create an AI Voice, Smooth may collect or process:
- voice recordings you provide to create your AI Voice;
- characteristics or information derived from your voice; and
- voice profiles, voice models, embeddings, or similar data used to generate your AI Voice.
We refer to this information collectively as "Voice Data."
2. Purpose
Smooth processes Voice Data only as necessary to create, provide, maintain, and support the AI Voice translation and interpretation features requested by the user.
Smooth may transmit Voice Data to third-party voice technology providers, including Fish Audio, as necessary to provide voice cloning and speech generation functionality.
3. Retention
Smooth retains Voice Data only for as long as necessary to provide the AI Voice feature.
Voice recordings collected specifically for AI Voice creation are deleted from Smooth's systems after they are no longer necessary to create or provide the AI Voice.
Voice profiles, models, embeddings, or similar derived Voice Data may be retained while the user maintains an AI Voice with Smooth.
Smooth will permanently destroy Voice Data in its possession when the earliest of the following occurs:
- the user deletes their AI Voice;
- the user deletes their Smooth account and the Voice Data is no longer necessary;
- the original purpose for collecting the Voice Data has been satisfied; or
- three years have passed since the user's last interaction with Smooth.
4. Destruction
When Voice Data reaches the end of its applicable retention period, Smooth will delete or otherwise permanently render inaccessible the Voice Data maintained in Smooth-controlled systems.
Where Voice Data has been provided to a third-party service provider to provide the AI Voice functionality, Smooth will initiate or request deletion of the applicable Voice Data in accordance with the provider's available deletion procedures and applicable legal requirements.
5. User-Initiated Deletion
Users may delete their AI Voice at any time through the Smooth application or by contacting us at: support@trysmooth.ai
Upon receiving a valid deletion request, Smooth will stop using the applicable Voice Data to provide future AI Voice functionality and initiate deletion in accordance with this policy.
6. Exceptions
Smooth may retain information for a longer period only where retention is required by applicable law or pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.
7. Updates
Smooth may update this policy from time to time to reflect changes in our services, technology, or legal requirements.
Material changes will be communicated where required by applicable law.
